Director of Contracts

Summary: The Director of Contracts will lead and manage the full range of contract and subcontract administration functions to ensure satisfaction of legal requirements, customer specifications and government regulations; acts as a liaison to all levels of the organization, providing contractual domain knowledge in implementation, execution and administration. Responsible for the overall process of developing and negotiating contracts on both competitive and non-competitive basis and ensuring team meets deliverables in support of the growth objectives of the organization.  Position leads and manages contract administration staff.

 

Essential Duties and Responsibilities include the following, though other duties may be assigned as needed that are not detailed below.

 

General:

  • Manage full life cycle of all award/contract administration functions in close collaboration with Finance, Legal and Program staff including:

o   Reviewing award agreements including:

  • Evaluation of terms and conditions for business risks
  • Soliciting and documenting feedback from other departments for input into the negotiation process
  • Documenting review and approval of agreements for execution

o   Documenting restrictions and key compliance requirements

o   Conduct periodic reviews to ensure contract management activities are compliant with all applicable federal and non-federal funding rules and regulations and award terms and conditions

o   Coordinating other contractual matters to ensure all obligations and reporting requirements are met in accordance with all applicable federal and non-federal funding rules and regulations and award terms and conditions

o   Managing contract close out

o   Managing retention of all relevant contractual documents in compliance with audit requirements

  • Serve as main point of contact with staff on matters related to awards/subcontract administration and/or compliance
  • Manage central repository of all contracts, workorders, modifications, non-monetary agreements (e.g. team in agreements, memoranda of understanding, non-disclosure agreements, etc.) and other contract management instruments as necessary

 

Pre-award activities

  • Conduct review of solicitations/request for Proposal (RFPs) and communicate concerns to business development staff, technical team and others. The initial review would include interpreting funder regulations and restrictions identifying key compliance requirements and clarifying issues, and identifying possible business risks.

Compliance

  • Maintain an up-to-date awareness of current and changing regulations, policies and procedures (including FAR, Uniform Guidance, GSA, SCA, Davis Bacon, and organizational policy requirements) and answer most questions on major regulations without assistance
  • Contribute to internal compliance revisions/audits as directed by management as well as support external financial or funding agency audits

Award Management

  • Manage all contracts, including Indefinite Delivery, indefinite Delivery (IDIQ) contracts/ BPA/ and other contract vehiclesincluding support of Task Order proposals, exercise of options on contracts, contracts renewal, and collaboration with staff responsible for individual task order contract administration to ensure compliance with contract restrictions and reporting requirements
  • Provide award start-up support including issuing notification of awards and modifications and distribution of official documentation to all required personnel through Contract Award Briefs, and project set-up in the ERP system

 

 

 

CompetencyTo perform the job successfully, an individual should demonstrate the following competencies:

 

  • Detailed knowledge of the FAR, DFARS, and GSA Schedules.

 

  • Experience writing subcontracts with little to no oversight.

 

  • Draft and review of teaming agreements and NDA’s.

 

  • Detailed knowledge and understanding of different contract types (FFP, T&M, Cost Plus, and Hybrid)

 

  • Demonstrated ability to negotiate contracts.

 

  • Possess highly developed attention to detail.

 

  • Adept at developing and supporting a positive work environment.

 

  • Excellent verbal and written communication skills

 

  • Ability to build strong relationships

 

  • Self-confidence and self-starter

 

  • Office automation tools (MS Office etc.)

 

 

To perform this job successfully an individual, in addition to the requirements above, will benefit from having the following abilities and experience.

 

  • Experience working for a Small Business and/or 8(a) ANC/ Tribal organization is a plus.

 

  • Experience working in multiple market segments with the federal government

 

  • Ability to read, analyze, and interpret common scientific and technical documents, financial reports, and legal documents.

 

  • Ability to respond to common inquiries or complaints from customers, regulatory agencies, or members of the business community.

 

  •  Ability to write presentations, speeches and documents for use internally and to the external audiences that conform to prescribed style and format.

 

  •  Ability to effectively present information to top management, public groups, and/or boards of directors.

 

  • Ability to work with mathematical concepts such as probability and statistical inference.

 

  • Ability to apply concepts such as fractions, percentages, ratios, and proportions to practical situations.

Qualifications: 

 

Education/Experience

  • Requires Bachelor’s degree in business, finance, or related field, plus a minimum 10 years of experience in government contracting or compliance or a Master’s degree plus a minimum of 5 in government contracting and compliance
  • In addition to required education, minimum 5 years supervisory experience.
  • Experience in federal business sector contracting
